Wills

What is a Will?

A Will is a legal document that outlines what should happen to your money, property, and possessions after your death. It also allows you to appoint trusted individuals to carry out your wishes and, where applicable, make arrangements for the care of your children.

Having a valid Will is a crucial part of estate planning, ensuring that your estate is distributed according to your intentions rather than default legal rules.

Why Make a Will?

A Will allows you to:

- Decide who inherits your estate

- Appoint executors to manage your affairs

- Choose guardians for your children

- Make specific gifts or donations

- Help reduce uncertainty and stress for your family

Having a properly prepared Will provides clarity and peace of mind for both you and those close to you.

What Happens If You Don’t Have a Will?

If you die without a Will, your estate will be distributed according to the rules of intestacy. This can lead to:

- Loved ones not receiving what you intended

- Unmarried partners receiving nothing

- Delays and complications in administering your estate

These rules apply regardless of your personal wishes.

What Makes a Will Valid?

For a Will to be legally valid in England & Wales, it must:

- Be in writing

- Be signed by you

- Be witnessed by two independent adults at the same time

- Be made voluntarily and with mental capacity

If these requirements are not met, the Will may be invalid.

Keeping Your Will Up to Date

Your Will should be reviewed regularly, particularly after major life events such as:

- Marriage or divorce

- Birth of children or grandchildren

- Buying property

- Changes in financial circumstances

An outdated Will may no longer reflect your wishes.
