Terms and Conditions

Terms and Conditions of Service

Effective Date: 01/01/2026

1.  Introduction

These Terms and Conditions govern the provision of services by Axis, the trading name of Jack Gould (“we”, “us”, “our”), to you (“the Client”).

By engaging our services, you agree to be bound by these Terms.

2.  About Us

Axis is the trading name of Jack Gould, a sole trader operating in England & Wales.

We provide services relating to wills and Lasting Powers of Attorney (“LPA”).

3.  Regulatory Status

We are not regulated by the Solicitors Regulation Authority and do not act as solicitors.

However, we are legally trained in matters relating to wills, Lasting Powers of Attorney, and probate and trust work, and provide guidance and document preparation services based on that training and experience.

We do not provide regulated legal advice. Where your circumstances are complex or require specialist input, we recommend that you seek independent advice from a qualified and regulated lawyer.

4.  Scope of Services

Our services include:

  • Drafting wills based on your instructions
  • Advising on the creation and process of LPAs
  • Assisting with completion and submission of LPA applications to the Office of the Public Guardian
  • Providing updates to wills previously drafted by us

We do not:

  • Provide regulated legal advice
  • Act as executors or attorneys
  • Store original wills or legal documents

5.  Client Responsibilities

You agree to:

  • Provide accurate, complete, and up-to-date information
  • Carefully review all documents before signing
  • Ensure documents are properly executed and witnessed in accordance with legal requirements
  • Inform us promptly of any changes to your circumstances

We are not responsible for errors arising from inaccurate or incomplete information provided by you.

6.  Fees and Payment

We operate on a fixed-fee basis, which will be agreed with you prior to commencing work.

  • Payment may be required in advance
  • Work may not begin until payment is received
  • Unless otherwise agreed, fees are non-refundable once work has commenced

7.  Cancellation and Cooling-Off Rights

If you are a consumer, you have the right to cancel within 14 days of entering into a contract under the Consumer Contracts Regulations.

If you request that work begins within this period:

  • You may lose your right to cancel
  • You may be charged for work completed up to the point of cancellation

8.  Limitation of Liability

To the fullest extent permitted by law:

  • Our total liability is limited to the amount paid for the services
  • We shall not be liable for any indirect or consequential loss

We are not responsible for:

  • Improper execution or witnessing of documents
  • Failure to submit documents correctly where submission is handled by the Client
  • Delays or decisions made by third parties, including the Office of the Public Guardian
  • Changes in law or personal circumstances after completion

Nothing in these Terms excludes liability for death or personal injury caused by negligence or any liability that cannot be excluded under the laws of England and Wales.

9.  Professional Indemnity Insurance

We maintain professional indemnity insurance appropriate to the nature of our services.

10.  Confidentiality

We will treat all client information as confidential and handle it in accordance with our Privacy Policy.

11.  Data Protection

We process personal data in accordance with applicable data protection laws, including the UK GDPR.

12.  Termination

We reserve the right to refuse or terminate services where:

  • You provide false or misleading information
  • There is a conflict of interest
  • We are unable to proceed for legal or practical reasons

13.  Governing Law

These Terms and Conditions are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14.  Changes to These Terms

We may update these Terms from time to time. Updated versions will be made available on our website.
